Terms and Conditions of Service¶
Introduction and acceptance¶
Welcome to OBMessage, an integrated communication and customer service platform developed and operated by OFIMATIC SRL (“Ofimatic”, “we”, “us”, or “our”).
By accessing, registering for, or using any of our services, including messaging (Omnify), queue and ticket management (SmartQueue), or the conversational chatbot (Aless), you (“User” or “Client”) accept these Terms and Conditions of Use, which constitute a legally binding agreement between you and Ofimatic.
If you do not agree with any provision, you must refrain from using the service.
Definitions¶
- OBMessage: messaging, ticket management, chatbot, and omnichannel integration platform developed by Ofimatic.
- Aless: chatbot and conversational automation module based on artificial intelligence and configurable flows.
- SmartQueue: queue management and ticket-based service module integrated into OBMessage.
- User: natural or legal person who accesses the service, either through their own account or through authorized integrations.
- Complementary services: additional features such as integration APIs, administrative panels, service screens, or analytics components.
- Account: set of credentials and configurations that allow the user to access one or more services within the OBMessage ecosystem.
Terms of use¶
By using OBMessage and its associated modules, the user agrees to:
- Comply with all applicable laws, rules, and regulations.
- Not use the services for unlawful, fraudulent, or abusive purposes.
- Not interfere with the operation of systems, servers, or integrations.
- Not violate, modify, or replicate the source code, database, or system architecture.
- Not use chatbot or messaging services to distribute spam, phishing, or unauthorized content.
Non-compliance may result in immediate suspension of the service and possible legal action.
User accounts and access¶
Each user must create a valid account to access OBMessage services. You are responsible for:
- Maintaining the confidentiality of your username and password.
- Ensuring that the registered information is accurate and up to date.
- Reporting any unauthorized access.
Ofimatic is not responsible for losses caused by misuse of credentials. For security reasons, Ofimatic does not have direct access to users’ passwords.
Services included in OBMessage¶
a) Messaging service¶
Allows the sending, receiving, and management of messages through multiple channels, such as email, SMS, WhatsApp, and web chat, among others.
The user agrees not to send unsolicited bulk communications (spam) and to comply with applicable privacy and communication laws.
b) Chatbot service (Aless)¶
Allows response and service automation through artificial intelligence or configurable flows.
The user is responsible for the content, responses, and behavior of their configured chatbot. Using Aless to distribute false or discriminatory information, or information that violates third-party rights, is prohibited.
c) Queue and ticket service (SmartQueue)¶
Facilitates the management, assignment, and monitoring of service queues.
Ofimatic provides tools for recording, tracking, and analyzing service metrics. Service data belongs to the client, but the system and its algorithms are the exclusive property of Ofimatic.
Service modifications and updates¶
Ofimatic may update or modify the service and its modules, including messaging, Aless, and SmartQueue, to improve functionality, performance, or security.
Any relevant change will be notified through publication on the website or electronic communication. Continued use of the service implies acceptance of such updates.
Legal compliance and restrictions¶
The user guarantees that their use of the service complies with the laws applicable in their jurisdiction, including:
- Personal data protection legislation.
- Cybersecurity standards.
- Electronic communication and privacy regulations.
Any misuse may result in suspension or termination of the service.
Intellectual property¶
All intellectual property rights related to OBMessage, SmartQueue, and Aless, including software, documentation, designs, and logos, are the exclusive property of OFIMATIC SRL.
Use of the service does not imply assignment or transfer of rights. The user receives only a limited, non-exclusive, and revocable license to use the service in accordance with these terms.
Limitation of liability¶
Ofimatic provides OBMessage and its modules “as is”. It does not guarantee uninterrupted availability or complete absence of errors.
Ofimatic is not liable for indirect damages or economic losses arising from use of the service, failures in third-party services such as WhatsApp, SMS providers, email, or voice services, or technical issues caused by inadequate user configurations.
Severability and validity¶
If any provision is found to be invalid or unenforceable, the remaining provisions will remain in force.
The clauses regarding intellectual property, confidentiality, limitation of liability, and legal compliance will remain in effect even after termination of the service.
