Service Ownership Rights Policy¶

Intellectual property and reserved rights¶

OBMessage, including all its modules, components, integrations, and derivative services, such as Aless, is a platform exclusively owned by Ofimatic.

All intellectual property rights related to the platform, its source code, interfaces, documentation, design, architecture, features, databases, trademarks, logos, and trade names are and will remain the exclusive property of Ofimatic or its authorized licensors.

The reproduction, copying, distribution, modification, reverse engineering, translation, decompilation, or any other unauthorized use of the software, its components, or documentation is strictly prohibited without Ofimatic’s prior written consent.

License of use¶

Access to and use of the OBMessage service does not, under any circumstances, imply the assignment or transfer of intellectual property rights.

The client or user only obtains a limited, non-exclusive, non-transferable, and revocable license of use, granted in accordance with the terms of the current contract or service agreement.

Client rights¶

The client retains all rights over:

The data registered or generated through the service.
The logos, trademarks, or proprietary content uploaded to the platform.
The operational or business information resulting from their internal management.

However, the client grants Ofimatic a limited and temporary right to use such data solely for the purpose of providing, maintaining, and improving the service.

Trademark protection and confidentiality¶

The OBMessage name, its logo, and associated trademarks, including Aless, are protected by national and international industrial property and copyright laws.

The user agrees not to use such names, logos, or distinctive signs in a way that may create confusion or mislead others regarding their ownership.

Likewise, all technical or commercial information related to the service is considered confidential and may not be disclosed without express authorization from Ofimatic.

Continuity of specific terms¶

Even after termination of the contract or service use agreement, the following provisions will remain in effect indefinitely:

Copyright and ownership rights corresponding to Ofimatic.
Intellectual property rights corresponding to the client.
Clauses regarding limitation of liability, absence of warranties, confidentiality, indemnification, and contractual severability.

Legal compliance¶

This policy is governed by the legislation in force regarding intellectual property and software protection.

Ofimatic reserves the right to take the corresponding legal actions in the event of violation, copying, misuse, or unauthorized distribution of its technology or documentation associated with the OBMessage service.
